Snijlab is a production company specializing in the computer-controlled cutting of various sheet materials. We offer customers the ability to convert their designs into physical products via an online ordering environment. In addition, we offer design and development assistance and sell our own products and products from third parties.
- In these terms and conditions, Snijlab is referred to as “We”, “us”, “our”, or “Snijlab”.
- In these terms and conditions, the customer is referred to as “customer” or “client”.
- A customer is understood to be: a person who uploads a drawing to our website or a person who otherwise places an order with us or enters into an agreement with Snijlab.
- A model is understood to be: a representation of a design, for example in the form of (digital) drawings, CAD models, sketches, design descriptions, or prototypes.
Customer's Intellectual Property Rights
The customer retains the intellectual property rights to their products, models, and production drawings.
We will not publish products, models, or production drawings submitted to us, nor provide them to third parties, without the explicit permission of the customer.
The customer must possess all relevant ownership or user rights for the provided models and production drawings. Snijlab assumes that the customer has these rights. Snijlab cannot be held liable for claims relating to intellectual property rights of provided models or production drawings.
We reserve the right to refuse orders if there is a suspicion that the customer does not possess the necessary proprietary rights, if a model or production drawing violates legal provisions, or at our own discretion.
Snijlab's Intellectual Property Rights
When Snijlab performs drawing, design, concept development, or similar work, it retains the intellectual property rights to its own work, unless otherwise agreed. Photos taken by Snijlab contain copyright and may not be reproduced or used without explicit permission.
Use by Third Parties
When we make products, models, or drawings available for use by third parties (via website, spoken word, or any other medium), we do so, unless otherwise stated, under a Creative Commons Attribution-ShareAlike (CC BY-SA 3.0) license. This means the following:
The user may:
- copy, distribute, and transmit the work.
- Remix - create derivative works.
- use the work for commercial purposes.
Under the following conditions: - Attribution — The user must attribute the work to “Snijlab” and include the URL “www.snijlab.nl” (but not in any way that suggests Snijlab endorses the work or its use).
- ShareAlike — If the user modifies the work, the resulting work may only be distributed under the same license as this one or a similar license.
A different license may apply per project.
Prices
Snijlab calculates prices for cutting orders in advance based on the digital production drawing provided.
While we do our best to make an accurate estimate, production costs may turn out to be higher than calculated. Higher production costs are borne by Snijlab, but should this difference be too great in our opinion, Snijlab may refuse the order. The customer will be informed as soon as possible and the paid amount will be refunded.
Any shipping or transport costs to the delivery address are borne by the customer.
All prices are subject to printing and software errors.
Warranty
We only guarantee that the products made by Snijlab meet the specifications of the submitted drawing and the chosen material, taking into account the usual tolerances.
A drawing uploaded or otherwise provided by the customer is, unless expressly stated otherwise by the customer, interpreted as the final production drawing and will be produced without modifications.
By default, finished products are supplied unfinished, meaning phenomena from the production process (e.g., smoke residue, melted edges and/or reflection, kerf) may be visible.
We do not guarantee that a product made by us will be suitable for a particular purpose.
Snijlab therefore does not replace or reimburse products when there is a problem with the design, material choice, or functionality. The customer should assume that several attempts are needed to perfect a design. Prototyping and refinement are integral parts of the design process, especially when making interlocking parts.
If a product does not meet specifications or proves to be defective, the customer must immediately inform us in writing of all defects. Do not return products unless requested by us. In consultation with us, the customer may choose replacement, repair, or refund of the purchase amount.
Delivery Time
The delivery time is estimated by Snijlab before purchase. We aim to deliver products within 5 business days for shipping or pickup.
An urgent service where products can be delivered within a few hours is available in some cases after telephone consultation. Additional costs will be charged for this.
The delivery time only commences when the customer has agreed to the price quote or offer and when all necessary commercial and technical information etc. (including production drawings, desired material, contact details) has been received by us.
Changes in production drawings, desired material, or requested quantities may lead to additional or less work, resulting in different costs and delivery times.
Exceeding the delivery time does not entitle to compensation in any case, unless agreed upon in writing.
While we do our utmost to ensure products reach the customer as quickly as possible, we are not liable for any delays caused by the postal service or carrier.
Supplying Your Own Material
Snijlab supplies a wide range of materials from which a product can be made and strives to use these materials in the production of products.
However, under the following conditions, it is possible for the customer to supply their own material:
The type and origin (supplier) and value of the material must be stated in writing upon delivery. The customer must supply at least 10% more material than is necessary for production to account for any wastage. Additionally, an extra piece of material of at least 100x100mm is required for a cutting test. Snijlab may charge 25% of the market price of the supplied material to cover additional costs. If the customer is acting on behalf of a company, Snijlab is not liable for damage to the supplied material resulting from an improperly performed process. At the customer's request, we will repeat the process with new material supplied by the customer at their expense.
Returns
Non-custom-made products can be returned within 7 days of purchase, after which the full purchase amount will be refunded.
Upon return, shipping costs and shipping risk are borne by the customer.
Products custom-made by us cannot be returned.
Retention of Title
Delivered goods remain the property of Snijlab until full payment has been received.
Applicability of General Terms and Conditions
These terms and conditions apply to all offers made by Snijlab, to all agreements it concludes, to all agreements that may result therefrom, to the use of Snijlab's website, and to all our other services.
An agreement is concluded through an online order, an email confirmation, a telephone confirmation, or verbal confirmation.
Purchase conditions used by other parties are not applicable.
Applicable Law
Dutch law applies to agreements concluded by Snijlab.
Only the Dutch civil court competent in Snijlab's place of establishment shall hear disputes, unless this conflicts with mandatory law. Snijlab may deviate from this rule of jurisdiction and apply the statutory rules of jurisdiction.
